No need for a sidebar. The Supreme Court ruled years ago in United States v. New Jersey (1793) that “(s)he who smelteth it, in fact, dealteth it.” Chief Justice Jay was the lone dissenter, noting that “those who denieth it, may often supplieth it,” but that there was “no proven causality between the defendant’s sensory capability and his capacity to form the mens rea necessary for a denial”
